Often when companies get embroiled in legal battles, the smaller/newer player is found at a disadvantage since it may not have the funds to fight a long drawn, and possibly ugly legal battle. Realising this, DailyBasket has taken its legal tussle with BigBasket public. Recently, BigBasket sent a cease and desist legal notice to DailyBasket for using the word ‘basket’ in its domain name.

The currently localised online grocery service has launched a website called bbisabully.com. Apart from the transparently cheeky domain, the website lands the user on a page that list the details of the claims made by BigBasket, followed by a bullet pointed rebuttal by DailyBasket.

One of the key points made on bbisabully.com states that no company has the right to exclusively use ‘basket’ as part of its name. “Except the word ‘basket’, there are no similarities or trademark violations in the brand logo. Colors are different, font is different, graphics is different and the name itself is different. So they want to sue us because we have ‘basket’ in our name. Last time we checked no one has monopoly in the word ‘basket’ or having the word ‘basket’ and selling groceries online. NaturesBasket.com was actually started in 2005, way before bigbasket,” reads the text on the site.

The website also has a slider feature that allows the reader to compare the website, app interface, and the logos of the two brands side by side. The rebuttal is followed by a copy of the legal notice sent to DailyBasket by BigBasket.

The website then lists what the people at DailyBasket intend to do about the impending legal proceedings, and list out how users can help. Not mincing words, the website claims BigBasket is practicing corporate bullying. “We put this in open so we want to fight them in public. We are a tiny bootstrapped company currently only serving in Coimbatore and about to open our first physical location. We don’t have that mighty power & money bigbasket possess to engage in endless lawsuits and unlawful intimidations. But we will show the truth in public to everyone to see what bigbasket has become. And how a big billion dollar company sees an upcomer as a competition and trying to eliminate us with corporate bullying,” reads the text on bbisabully.com.

“You are crying foul when you are the one engaging in unfair competition & unlawful demands with a tiny 2 person startup,” it adds.

It ends with a request to users to spread the word “till we hear something good from bigbasket.”

It is not new for brands to drag each other to court over various perceived business infractions. In the past few months itself, we have seen many brands take their competitors to court, the Sebamed and HUL spat being freshest in memory.
